We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

These Terms of Service constitute a legally binding agreement formed electronically between you and Sairam Solutions Ltd. By visiting our site, purchasing something from us, or enrolling in our B2B/Wholesale programs, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including our Return & Refund Policy, Shipping Policy, and any additional terms referenced herein. If you do not agree, you may not access the website or use our Services.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, or you have given consent for any minor dependents to use this site. You may not use our products or Services for any unlawful or unauthorized purpose or violate any applicable laws. Any breach of these Terms may result in immediate termination of your access to our Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone, cancel or limit orders, or restrict access to our website at our sole discretion.

Account Security & B2B Portal: If you are provided with an account or B2B Portal login, you are responsible for maintaining the confidentiality of your credentials. You agree to accept responsibility for all activities that occur under your account.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service (including product descriptions, photography, guides, and blog content) without express written permission. Unauthorized use of our Intellectual Property will result in strict legal action.

SECTION 3 – MEDICAL, SAFETY & THIRD-PARTY LIABILITY SHIELD

A. Medical & Holistic Disclaimer: Sairam Solutions Ltd. is a lifestyle retailer. We do not provide medical advice. Products sold by us—including Ayurvedic copper vessels (Tamra Jal), Kansa metalware, botanical skincare, and Vastu/Astrological items—are intended for personal, cultural, decorative, and holistic use only. They are not intended to diagnose, treat, cure, or prevent any disease. We make no guarantees regarding health improvements, financial success, or spiritual outcomes. Any reliance on this information is strictly at your own risk.

B. Product Risk, Water Chemistry & Safety Assumption: You acknowledge that certain products carry inherent physical and chemical risks. We accept zero liability for cuts or physical damages from grooming hardware. Furthermore, our 100% pure copper vessels are highly reactive; we have no control over your local water source or the acidity of the liquids you introduce. We are not liable for biological reactions, nausea, or illness resulting from improper water sourcing or leaving liquids in the vessel beyond recommended timeframes (8–12 hours). Wearing pure copper wearables may also naturally cause temporary, harmless skin discoloration (a green tint) due to individual body chemistry; this is a natural reaction, not a defect, and we assume no liability for individual dermal reactions.

C. Third-Party Manufacturer Liability: For items where Sairam Solutions Ltd. acts as an authorized retail stockist (including, but not limited to, Henson Shaving, Rockwell Razors, DOVO Solingen, Merkur, and Proraso), we act solely as a reseller. We explicitly disclaim all product liability, implied warranties, and manufacturing defect responsibilities for third-party goods. All claims regarding product failure or safety recalls must be directed to the original manufacturer.

D. Fire Safety & Aromatherapy Liability: By purchasing candles, incense, or aromatherapy products, you assume all risks associated with open flames. Sairam Solutions Ltd. is not liable for any property damage, fire, smoke damage, or personal injury caused by unattended, misused, or improperly placed candles. Always burn candles in sight, away from drafts and flammable materials, and out of reach of children and pets.

SECTION 4 – MODIFICATIONS TO SERVICE, PRICING & CANCELLATIONS

Prices and product availability may change without notice. We reserve the right to modify or discontinue any product or Service, or cancel orders due to errors or availability issues.

12-Hour Cancellation Policy: Due to our rapid logistics fulfillment pipeline, customers have a strict 12-hour window from the time of order placement to request a cancellation or address modification by emailing connect@samahomes.ca with "URGENT CANCELLATION". Once an order exceeds 12 hours, has been processed, packed, or assigned a carrier tracking number, it cannot be canceled or intercepted and must proceed under our standard Return & Refund Policy upon delivery.

SECTION 5 – PRODUCTS, MATERIAL CARE & NATURAL CHARACTERISTICS

Certain products may be available exclusively online and in limited quantities. We make reasonable efforts to display product images accurately, but cannot guarantee exact representation due to natural material variations.

Natural Characteristics (Patina & Odors): Authentic Ayurvedic metals (pure copper, brass, Kansa) and artisan woods possess natural characteristics. Natural oxidation (patina development) and inherent earthy or metallic odors (from the materials or their eco-friendly packaging) are definitive chemical proofs of purity and authenticity, not manufacturing defects.

Material Transparency & Cap Engineering: By purchasing our hydration vessels or related products, you legally acknowledge that you have reviewed and accepted our Material Transparency & Cap Disclosure (made available via our product pages and website footer). You expressly understand and agree to the functional necessity of BPA-free, food-grade synthetic polymers and silicone seals utilized to create a safe, leak-proof experience. Objections to these fully disclosed materials do not constitute grounds for a refund, and claims of false advertising regarding these properly disclosed components are strictly prohibited.

Misuse & Dishwasher Clause: Handcrafted wood, pure copper, and Kalai-lined brass items are strictly "Hand Wash Only." Structural damage, warping, or lining degradation caused by automatic dishwashers or prolonged water soaking constitutes severe customer negligence and instantly voids all return, warranty, and replacement protections.

SECTION 6 – BILLING, INTERNATIONAL CUSTOMS (DDU), CHARGEBACKS & DELIVERY

We reserve the right to refuse or cancel any order. By providing a payment method, you warrant that you are authorized to use it and authorize us to charge the full amount.

Third-Party Financing & Installments (Klarna / PayPal): If you select a "Buy Now, Pay Later" service, installment plan, or gateway wallet (such as Klarna or PayPal), you acknowledge that the payment financing agreement exists strictly between you and that provider. Sairam Solutions Ltd. does not control installment schedules, late penalty fees, interest calculations, or financing terms. In the event of an approved refund, funds are routed strictly through the original provider; we cannot issue cash or alternative payment methods to bypass financing contracts.

Physical Delivery Verification: Orders confirmed as "Delivered" via the carrier’s electronic tracking record, time stamp, carrier GPS scan coordinates, or signature Proof of Delivery (POD) shall be deemed legally fulfilled. Sairam Solutions Ltd. is not liable for packages stolen post-delivery (porch piracy) or delivery failures resulting from incorrect addresses provided by the customer at checkout.

Digital Goods & Gift Cards: Digital gift cards are fulfilled instantly via email. We actively log IP addresses, check-out details, and email delivery timestamps. Delivery of the email to the provided address constitutes absolute legal fulfillment. Digital assets are strictly final sale.

International Customs Duties (DDU/DAP) & Forced Returns: All international shipments leaving Canada are dispatched on a Delivered Duty Unpaid (DDU/DAP) basis unless expressly stated otherwise. You are the official importer of record and are 100% legally and financially responsible for paying all local customs duties, taxes (VAT/GST), and carrier clearance brokerage fees mandated by your destination government.

Refusing to accept a parcel, failing to pay assessed customs duties, or abandoning a shipment at customs constitutes an Unauthorized Forced Return. In such events, Sairam Solutions Ltd. will deduct the following documented costs from any potential refund:

• Actual Courier Return Freight: The exact return transit costs billed to Sairam Solutions Ltd. by the international carrier to transport the refused shipment back to Canada;
• Return Clearance & Brokerage Fees: Non-recoverable carrier entry brokerage fees and customs administrative charges incurred upon re-entry into Canada;
• Original Outbound Shipping: Initial outbound shipping costs incurred to dispatch the order.

Total Forfeiture Rule: If courier return freight and entry clearance fees equal or exceed the total product price, or if destination customs authorities seize or destroy the abandoned package, **the goods are forfeited and the refund amount is zero ($0.00).**

Anti-Fraud & Dispute Protection: Filing an "Item Not Received" (INR) or chargeback dispute with a bank, credit card issuer, PayPal, or Klarna because an international package is held awaiting customs duty payment, or because you refused to pay local import charges, constitutes a material breach of these Terms and fraudulent misuse of buyer protection programs. Sairam Solutions Ltd. actively submits checkout verification records, IP logs, carrier tracking scans, and these agreed-upon Terms to financial arbiters to reverse unjustified disputes and recover incurred losses.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” without warranties. Use of such tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party websites or content and disclaim all liability related to third-party interactions.

SECTION 9 – USER SUBMISSIONS

You agree that any submissions (comments, feedback, ideas) may be used by us without restriction or compensation. We may remove content that is unlawful or violates these Terms.

SECTION 10 – PERSONAL INFORMATION

Your submission of personal information is governed by our Privacy Policy.

SECTION 11 – ERRORS & OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions and cancel orders at any time without prior notice.

SECTION 12 – PROHIBITED USES & AUTOMATED SCRAPING

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

• For any unlawful, abusive, or fraudulent purpose.
• To violate any international, federal, provincial, or state regulations, rules, or laws.
• To infringe upon or violate our intellectual property rights (including our custom schemas, guides, and photography) or the intellectual property rights of others.
• To upload or transmit viruses or any other type of malicious code.
• Automated Scraping & AI Data Harvesting: You may not use unauthorized spiders, scrapers, or automated tools to extract data, pricing, or proprietary catalog structures from our website. Sairam Solutions Ltd. explicitly grants crawling permission only to recognized search engine bots and authorized AI agents strictly conforming to our published robots.txt directives. Any unauthorized commercial resale or repackaging of our data feeds is strictly prohibited.

SECTION 13 – DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

All products and Services are provided “as is” and “as available”, without any warranties, express or implied, including merchantability, fitness for a particular purpose, durability, and non-infringement.
To the maximum extent permitted by applicable law, Sairam Solutions Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages, or loss of profits, revenue, or data. Total liability shall never exceed the amount paid for the product.

SECTION 14 – INDEMNIFICATION

You agree to indemnify and hold harmless Sairam Solutions Ltd. and its affiliates from any claims, damages, or expenses arising from your breach of these Terms, your misuse of products or Services, or your violation of any law or third-party rights.

SECTION 15 – SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 – TERMINATION

We may terminate or suspend access to our Services at any time without notice if you violate these Terms.

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with our published Return & Refund Policy and Global Shipping Policy, constitute the entire agreement between you and Sairam Solutions Ltd. and supersede all prior agreements.

SECTION 18 – GOVERNING LAW, JURISDICTION & CLASS ACTION WAIVER

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, subject to mandatory statutory consumer protection laws in your home jurisdiction that cannot be lawfully excluded. You agree to submit to the jurisdiction of the courts of Alberta. Class Action Waiver: You agree that any legal proceedings or dispute resolutions will be conducted solely on an individual basis and not in a class, consolidated, or representative action.

SECTION 19 – FORCE MAJEURE

We shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, supply chain disruptions, carrier strikes, destination customs holds, and government actions.

SECTION 20 – PRODUCT IMAGES DISCLAIMER

Product images are for reference only. Items or accessories shown may not be included unless explicitly stated in the product description. Claims based solely on images may be declined where product descriptions clearly define included items.

SECTION 21 – NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

SECTION 22 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any changes. Changes will apply to orders placed after the updated policy is published.

SECTION 23 – COMMERCIAL ADDENDUM: B2B, WHOLESALE & DROPSHIPPING

This section applies strictly to all business entities, independent retailers, digital merchants, and storefronts purchasing inventory via our wholesale channels, Faire, Syncee, or the SAMA Direct Dropship Program ("B2B Partners"). Commercial transactions are explicitly excluded from consumer cooling-off periods and statutory consumer withdrawal rights. By marketing, listing, or purchasing Sairam Solutions Ltd. inventory for resale, you agree to the following binding terms:

• Total Liability Indemnification: We act strictly as an upstream fulfillment logistics provider. We maintain zero legal or support relationships with your retail end-consumers. The B2B Partner assumes 100% liability for all sales, marketing claims, payment processing, product liability, and customer satisfaction expectations of their external shoppers.
• First-Tier Support Mandate: B2B Partners must handle all customer service communication and dispute resolutions with their retail buyers. We will not interact with or issue refunds to your end-consumers.
• The Consumer Return Prohibition: All commercial sales are strictly final. We do not accept returns or issue cash refunds for end-consumer buyer’s remorse, change-of-mind, or consumer maintenance neglect. Commercial damage or defect claims must be reported to connect@samahomes.ca within 24 hours of delivery and must include clear photo/video evidence of both the product and the exterior shipping packaging. Approved commercial claims will be settled strictly via wholesale account credit or direct product replacement.
• Brand & MAP Protection: B2B Partners must not alter brand logos, claim to manufacture our goods, or advertise our products below our established Minimum Advertised Price (MAP). Sairam Solutions Ltd. retains full ownership of all provided digital assets.
• Commercial Chargeback Prohibition: B2B Partners who initiate payment chargebacks against Sairam Solutions Ltd. for verified, dispatched, or delivered shipments will face immediate account termination and legal action to recover commercial damages.
• Customs Compliance & Freight Liability: Sairam Solutions Ltd. complies strictly with international export laws. We will not under-declare merchandise values, alter commercial invoices, or mark wholesale/dropship orders as "gifts". B2B Partners are 100% responsible for their end-clients' destination customs clearance. Any freight or abandonment penalties resulting from an end-client's customs rejection will be billed directly to the B2B Partner.
